Achievements and Challenges as the EACC CEO

Since taking office, Mbarak has vowed to make corruption a high-risk and low-reward venture in Kenya. He has adopted a multi-agency approach to coordinate and collaborate with other law enforcement agencies, such as the Office of the Director of Public Prosecutions, the Directorate of Criminal Investigations, the Asset Recovery Agency, and the Financial Reporting Centre. He has also strengthened and deepened the relationships with international partners, such as the United Nations, the African Union, the European Union, and the United States, to facilitate the investigative process and the recovery of stolen assets.

He has also focused on impactful investigations, prioritizing cases based on the value of the subject matter, the personalities involved, and the public interest. He has conducted a comprehensive audit of the cases and cleared the backlog of pending files. He has also enhanced the intelligence capabilities and undercover operations of the EACC, to identify and prevent emerging threats and opportunities for corruption.

Some of the notable achievements of Mbarak as the EACC CEO include:

  • The recovery of over Ksh 25 billion worth of public assets that had been illegally acquired or allocated by corrupt individuals, such as land, buildings, vehicles, and cash.
  • The prosecution of over 1,000 individuals, including senior government officials, politicians, businesspeople, and professionals, for various corruption-related offenses, such as abuse of office, bribery, fraud, money laundering, and economic crimes.
  • The completion of over 200 investigations, including some of the mega scandals that have rocked the country, such as the National Youth Service scandal, the Kenya Power scandal, the Kenya Pipeline scandal, the Arror and Kimwarer dams scandal, and the Covid-19 funds scandal.
  • The establishment of the EACC Academy, a state-of-the-art training and research facility, to enhance the capacity and professionalism of the EACC staff and other stakeholders in the fight against corruption.
  • The development and implementation of various policies and strategies to prevent and combat corruption, such as the National Ethics and Anti-Corruption Policy, the EACC Strategic Plan 2018-2023, the EACC Corruption Prevention Guidelines, and the EACC Whistleblower Protection Policy.
  • The promotion of public awareness and education on the dangers and effects of corruption, and the mobilization of public participation and support in the fight against corruption, through various platforms, such as the media, social media, public forums, schools, churches, and civil society organizations.

However, Mbarak has also faced several challenges and obstacles in his quest to eradicate corruption in Kenya. Some of these include:

  • The resistance and hostility from the corrupt cartels and networks, who have used their influence and resources to frustrate and sabotage the EACC’s efforts, through intimidation, threats, blackmail, propaganda, and litigation.
  • The lack of sufficient resources and capacity to effectively deal with the magnitude and complexity of corruption in the country, especially in the counties and the devolved units, where corruption has been rampant and pervasive.
  • The slow and inefficient judicial process, which has delayed and denied justice to the victims and the perpetrators of corruption, and eroded the public confidence and trust in the EACC and the rule of law.
  • The political interference and manipulation, which has undermined the independence and autonomy of the EACC and influenced the outcome of some of the investigations and prosecutions, especially during the electioneering period and the constitutional amendment process.
  • The low level of public awareness and education on the role and mandate of the EACC and the rights and responsibilities of the citizens in the fight against corruption, leading to apathy, indifference, and cynicism among the public.
