London, April 16, 2021 – The scam-accused billionaire Nirav Modi’s extradition to India has been cleared by the British government. The UK Home Secretary Priti Patel has signed the extradition order. Remember earlier the UK Westminster court had allowed the extradition plea and sent the case to the Home Secretary. The jeweler is warranted by the Indian courts for fraud for money laundering in the 14,000 crore Punjab National Bank of PNB loan scam.
And while his expedition was cleared, the UK judge had dismissed all arguments. This was in February that the mental health like his mental health was worsening during the pandemic poor Indian prison conditions etc.
The UK Home Secretary has signed the extradition order of Nirav Modi, who’s a fugitive in the Punjab National Bank scam. So this comes after two months the UK Westminister code allowed the extradition plea of the Indian authorities the Indian government through the agencies. The Ministry of External Affairs had approached the UK Government for the extradition of Nirav Modi.
So after this order, after the request from the Indian agencies through the MEA, the UK police had arrested Nirav Modi, and then he was produced before the UK Westminister court is still languishing in the prison. During that particular time, the UK Westminister court initiated the extradition proceedings. In the case proceedings against Nirav Modi in that particular case, the Indian agencies got a favorable order. Where in the UK Westminister Court allows the extradition of Nirav Modi. So as per the UK extradition act once the UK court the Local Code allows the extradition plea then the matter will be referred to the UK Home Secretary.
The UK Home Secretary has to clear the extradition signed extradition order within two months. So after two months sticking with the procedure of the UK extradition Act, the UK Home Secretary has signed the extradition order of Nirav Modi. So what lies next? Can Nirav Modi be brought to India the very next day? No, that’s not the case as per the UK extradition act within 28 days from the UK Home Secretary signing the order, Nirav Modi can file an appeal before the UK High Court and once the UK High Court use it order based on the order he can again challenge UK Supreme Court also so that’s what even Vijay Mallya also did.
In Vijay Mallya’s case, the UK Home Secretary had signed the extradition order in February 2019. That is two years back, but still, he has not been extradited because according to our sources in the UK, UK judicial process is a complicated process. So still Nirav Modi can challenge this order in the UK High Court and then he can again move the supreme court if the option is that. If not, he can again ask for asylum. Like how Vijay Mallya has done it, even after losing the case in High Court.
